July 25, 2013As anticipated by some, the Florida Office of Insurance Regulation filed a notice that an appeal would be taken in the case of Myers, et.al. vs. The Florida Office of Insurance Regulation, concerning the temporary injunction that was issued by the Court on March 15, 2013. Unfortunately, the notice of filing appeal has the effect of automatically staying Judge Lewis’ order of temporary injunction for the implementation of the 2012 PIP Act until the appeal is decided. Sources close to this matter are anticipating that the plaintiffs will be seeking their own relief from the stay that is automatically granted with the notice of appeal that has been filed.

One could further argue that the Court’s Order did not have far enough reach, in that it did not address the new Act’s requirements that an injured policy holder must obtain a determination of the need for emergency medical care. It is presumed that the Court did not address that issue in as much as the Plaintiffs in the case at bar lacked standing since they were not medical doctors.
