Just recently the CPSC announced a recall of approximately 500,000 Chicco Polly high chairs. The company, Artsana, announced the recall because of a defective design that has caused some laceration injuries among young children. Unfortunately, there have been some serious injuries that required stitches as well as one report of an eye injury. The latter would apply if only this group of recalled products is defective, as opposed to a design defect that runs throughout the entire product line.
Clearly it seems as if the parents of the children who have been injured wouldn’t have any issues proving damages since Artsana has announced the recall as a result of the injuries. Thus, I think any litigation regarding this product will depend on how the defect is framed, as discussed above. Of course, the best case scenario is that this recall prevents any subsequent injuries, especially because the product affects young children.
