Section 316.122 of the Florida Statutes specifically requires that the driver of a vehicle intending to turn to the left within an intersection, or into an alley, private road or driveway shall yield the right-of-way to any vehicle approaching from the opposite direction or vehicles lawfully passing on the left of the turning vehicle, which is within the intersection or so close thereto as to constitute an immediate hazard. Section 316.122 provides that a violation of this section is punishable as a moving violation. The incidence of drivers of vehicles disobeying this provision of yielding upon turning left has reached apparent epidemic proportions throughout the City of Weston, Florida.
One cannot, without conducting an appropriate statistical analysis, reach a singular conclusion as to why this is occurring. One explanation might be that many of the intersections in Weston involve turning into roadways that have multiple lanes in each direction, and therefore the vehicles turning left believe that they have the right to turn at the same time as a vehicle is attempting to make a right turn from the opposite direction at the same intersection. The law is very specific in requiring the vehicle intending to turn left to yield its right-of-way to the vehicle in the opposite direction.
