May 15, 2017USAA has agreed to pay $39 million to settle a Florida class action lawsuit that contested the way the insurer reimbursed customers for claims where an insured’s vehicle was totaled in a Florida car accident.
It was alleged that USAA was making payments to insureds to buy new vehicles after a Florida car accident, but failed to include funds to cover sales tax, until it was first paid by its members. The settlement calls for USAA’s insureds, who are comprised mainly of military members and their families, to receive 100% of the value of their respective claims with 8% interest.
Unfortunately, this is not the only Florida lawsuit alleging that insurers have shortchanged their insureds in paying claims resulting from Florida car accidents. Whether it be claims involving unreasonable delays in processing a claim, the denial of a claim before a proper investigation has been done, the cancellation of Personal Injury Protection (PIP) benefits, or others, many drivers throughout Fort Lauderdale, Weston, Hollywood, Miami and elsewhere, are forced to take legal action against their own insurer after a Florida car accident.
