July 25, 2013Several State and Federal Courts have rendered decisions in the past few weeks against the Chinese drywall manufacturer, Taishan Gypsum, considered to be the major Chinese manufacturer of drywall. While the Chinese manufacturer has argued both the lack of defect in its products and most impactfully, the lack of jurisdiction over its corporation in U.S. and Florida Courts; primarily since its drywall was sold in this country by other companies, a Federal judge in Louisiana recently ruled that Taishan Gypsum was responsible for its drywall sold in Florida, and several other Southern states.
There was a similar state court decision rendered in August as well Florida. Miami-Dade Circuit Court Judge, Joseph P. Fereno, ruled that the plasterboard company that exported the drywall to Florida was an apparent subsidiary of Taishan Gypsum and therefore the Chinese entity was subject to jurisdiction in the Miami-Dade Florida Circuit Court. The Court relied upon rather convincing indicia such as the fact that Taishan Gypsum was active in courting Florida companies by solicitously providing drywall samples to Florida companies, as well as supplying large quantities of drywall to Florida based companies.
Of course, Taishan Gypsum is appealing these rulings. Lawyers representing aggrieved homeowners have reported from seven to ten thousand homes were affected by allegedly defective Chinese drywall installed, after the recent hurricanes and during the rise in South Florida building.
And not just homeowners are interested in this ruling. Lennar Homes, which has allegedly spent more than 40 million dollars replacing defective drywall, is also seeking to recover from Taishan Gypsum.
